Please read these Terms of Service (“Terms”) carefully. They form a binding agreement between you and ColorSkein LLC and govern your use of colorskein.com.
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Site.
The Site is operated by ColorSkein LLC, a Georgia limited liability company (“ColorSkein,” “we,” “us,” or “our”), located at PO Box 3374, Alpharetta, GA 30005-9998. You can reach us at hello@colorskein.com.
The Site is not directed to children under 13, and you may not use it if you are under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the Site only with the involvement of a parent or legal guardian. By using the Site, you represent that you meet these requirements.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and material changes will be communicated through the Site or by other reasonable means. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Site.
You may use the Site for your own personal, non-commercial purposes, in a lawful manner. You agree not to:
We may investigate and take appropriate action, including restricting or terminating your access, if we believe you have violated these Terms.
The Site and all of its content — including text, graphics, logos, our curated color palettes and color data, the palette tools, layouts, design, images, and software — are owned by ColorSkein LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. The ColorSkein name and logo are our trademarks; you may not use them without our prior written permission.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No other rights are granted. You may share links to the Site freely.
Yarn names, brand names, product images, and merchant trademarks belong to their respective owners and are used for identification purposes only.
The Site lets you explore colors and assemble a palette and, if you choose, have a shopping list of your selections emailed to you. ColorSkein does not currently offer user accounts, and we do not save or store the palettes you assemble. Your selections exist only during your browsing session and in any shopping list email you ask us to send you.
Colors themselves cannot be owned, and a simple selection of colors generally does not qualify for copyright protection. Nothing in these Terms transfers to us any rights in the projects you make, and you are free to use the palettes you assemble for your own purposes, personal or commercial. Equally, nothing in these Terms grants you any rights in ColorSkein's curated palettes, color data, tools, or other content, which remain ours under Section 6.
If you send us feedback, suggestions, ideas, or other communications — for example through our contact form or by replying to one of our emails — you grant ColorSkein a non-exclusive, worldwide, royalty-free, perpetual license to use them for any purpose, including improving the Site, without obligation or compensation to you. Please do not send us information you consider confidential.
The Site contains affiliate links. ColorSkein LLC participates in affiliate advertising programs, including networks such as CJ Affiliate, Awin, and Impact. If you click an affiliate link and make a purchase, we may earn a commission at no additional cost to you. See our Affiliate Disclosure for full details and our Privacy Policy for how affiliate tracking works.
Affiliate relationships do not influence our editorial recommendations. We are not the seller of any yarn or product linked from the Site.
COLORS DISPLAYED ON THE SITE ARE APPROXIMATIONS AND MAY NOT MATCH THE ACTUAL YARN.
ColorSkein helps you explore and plan color combinations, but color as displayed depends on factors entirely outside our control, including your screen type, brightness, color calibration, operating system and browser color management, ambient lighting, and the accuracy of images supplied by merchants and manufacturers. Actual yarn color may also vary between dye lots, between production runs, and from photograph to physical product.
We make no representation or warranty that any color shown on the Site will match the yarn you receive. We strongly recommend ordering physical color cards or samples from the merchant before committing to a project. ColorSkein is not responsible for any dissatisfaction, cost, or loss arising from color differences.
We do not sell yarn. All purchases are made directly with third-party merchants through their own websites, under their own terms, policies, and prices.
Product availability, stock levels, dye lots, discontinuations, shipping, taxes, and prices are controlled entirely by those merchants and can change at any time without notice to us. Any price or availability information shown on the Site may be out of date or inaccurate. The price and terms displayed by the merchant at the time of checkout govern your purchase.
We make no guarantee that any yarn featured on the Site is, or will remain, available, in stock, or offered at any particular price.
Content on the Site — including color guidance, palettes, pairings, project ideas, and recommendations — is provided for general informational and educational purposes only. It is not professional advice, and we make no guarantee about the outcome of any project, purchase, or creative decision you make based on it. You are solely responsible for how you use the Site and the choices you make.
The Site links to third-party websites, including affiliate merchants. We do not control and are not responsible for their content, products, pricing, availability, shipping, returns, privacy practices, or terms. Links do not imply endorsement. Any transaction you enter into with a third-party merchant is solely between you and that merchant, and we are not a party to it. Direct any dispute about an order, payment, delivery, or return to that merchant.
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COLORSKEIN LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Site is free of viruses or other harmful components; or that any content, including color representation, availability, or pricing, is accurate, complete, current, or reliable.
TO THE FULLEST EXTENT PERMITTED BY LAW, COLORSKEIN LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In such cases, our liability is limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless ColorSkein LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site or your violation of these Terms or of any law or third-party right.
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — will survive.
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. Subject to Section 18, you and ColorSkein agree to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia, and waive any objection to venue in those courts.
Informal resolution first. If you have a dispute with us, please contact us at hello@colorskein.com with a description of the issue and the relief you seek. We will try in good faith to resolve it informally. You agree to give us 30 days from receipt of your notice to resolve the matter before initiating any formal proceeding.
If informal resolution fails. Any dispute not resolved informally will be brought exclusively in the state or federal courts described in Section 17, and you and ColorSkein each consent to personal jurisdiction there.
Small claims. Either party may bring an individual claim in small claims court if it qualifies.
Time limit. Any claim relating to the Site must be filed within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.
We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a written notice to hello@colorskein.com including: your contact information; identification of the copyrighted work; identification of the material you claim is infringing and its location on the Site; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the owner's behalf; and your physical or electronic signature.
We will respond to valid notices and may remove the material. We may also terminate access for repeat infringers.
Entire agreement. These Terms, together with our Privacy Policy and Affiliate Disclosure, are the entire agreement between you and ColorSkein regarding the Site, superseding any prior agreements.
Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our written consent. We may assign them freely, including in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
No third-party beneficiaries. These Terms do not create rights in any third party.
